Can Police Monitor Phone Calls

The company's systems, showcased at the DSEi arms fair in east London last month, allow authorities to intercept SMS messages and phone calls by secretly duping mobile phones within range into operating on a false network, where they can be subjected to "intelligent denial of service". This function is designed to cut off a phone used as a trigger for an explosive device.

The second way is by using a cell site simulator, commonly called a Stingray after the most common device, though it is no longer cutting edge. A cell site simulator “swamps” the cell site it’s located in (hence the other name, swamp box) and forces all of the cel phones connected to that site to register with the cell site simulator, just as they would do with the regular telco cell site. Once the target device is registered, it can be intercepted and located. This method is less preferred because it’s manpower intensive and, therefore, expensive.
Phone companies have a legal responsibility under the Telecommunications Act to protect consumer data, including call location, and can provide it in response to a legal order or sell it for use with customer consent. But lawyers interviewed by The New York Times disagreed on whether location information that was not gathered during the course of a call had the same protections under the law.

In order to obtain a court order for a wiretap, the police must show the probable cause required for a search warrant exists. In addition, the police must also show that they either unsuccessfully exhausted all other less intrusive means of investigation, or that those other means are too dangerous.
Mr. Wyden, in his letter to the F.C.C., also said that carriers had an obligation to verify whether law enforcement requests were legal. But Securus cuts the carriers out of the review process, because the carriers do not receive the legal documents.

Nick Pickles, director of privacy and civil liberties campaign group Big Brother Watch, warned the technology could give police the ability to conduct "blanket and indiscriminate" monitoring: "It raises a number of serious civil liberties concerns and clarification is urgently needed on when and where this technology has been deployed, and what data has been gathered," he said. "Such invasive surveillance must be tightly regulated, authorised at the highest level and only used in the most serious of investigations. It should be absolutely clear that only data directly relating to targets of investigations is monitored or stored," he said.
