Can Police Monitor Phone Calls

Emails are one of the most requested types of data, and there are loopholes that may allow police to access your inbox. The Electronic Communications Privacy Act (ECPA) allows police to access emails stored in the cloud that are at least 180 days old—and that includes drafts, documents, and photos.

In special circumstances, the police can get an emergency wiretap, where they will work with the phone company to setup the wiretap immediately and the prosecutor will have 48 hours to obtain a court order. This is not technically an "exception" because a court order is still needed, even if it comes after the wiretapping begins.

But it doesn’t stop there. Police have also utilized social network surveillance software, created by firms like Geofeedia and SnapTrends, which provides police with keyword and hashtag monitoring. In some cases, these firms have touted the ability to bypass privacy settings by creating mock accounts that gain them access to users’ private feeds.

Securus received the data from a mobile marketing company called 3Cinteractive, according to 2013 documents from the Florida Department of Corrections. Securus said that for confidentiality reasons it could not confirm whether that deal was still in place, but a spokesman for Mr. Wyden said the company told the senator’s office it was. In turn, 3Cinteractive got its data from LocationSmart, a firm known as a location aggregator, according to documents from those companies. LocationSmart buys access to the data from all the major American carriers, it says.

As long as they are following their own privacy policies, carriers “are largely free to do what they want with the information they obtain, including location information, as long as it’s unrelated to a phone call,” said Albert Gidari, the consulting director of privacy at the Stanford Center for Internet and Society and a former technology and telecommunications lawyer. Even when the phone is not making a call, the system receives location data, accurate within a few hundred feet, by communicating with the device and asking it which cellphone towers it is near.

In May the Guardian revealed the Met had purchased software used to map suspects' digital movements using data gathered from social networking sites, satnav equipment, mobile phones, financial transactions and IP network logs. The force said the software was being tested using "dummy data" to explore how it could be used to examine "police vehicle movements, crime patterns and telephone investigations."
